The Law

Capitol Building

We begin this section with a brief overview of the laws that apply to students with disabilities in higher education.

This section will cover these important concepts:

  • Section 504 and 508 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990 are civil rights statutes designed to prevent discrimination against students based on their disability.
  • These laws have four important implications for students with disabilities:
  1. They have a right to be in higher education if they are qualified for admission.
  2. Once admitted, they have a right to access all programs.
  3. They are eligible for academic adjustments relating to their disabilities.
  4. Students have a right to confidentiality of all disability-related information.
